situa\u00e7\u00f5es.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Segundo o art. 483 da CLT, essa quebra \u00e9 uma modalidade que se d\u00e1 por meio de uma falta grave que o empregador comete com seu funcion\u00e1rio, ocasionando em alguns benef\u00edcios ao mesmo.<\/span><\/p><p><span style=\"font-weight: 400;\">Ou seja, ele consegue realizar uma demiss\u00e3o por justa causa. Todavia, ela somente ser\u00e1 v\u00e1lida perante provas reais (v\u00eddeos, fotos ou \u00e1udios) das quais ser\u00e3o respons\u00e1veis por completar a den\u00fancia.<\/span><\/p><p><span style=\"font-weight: 400;\">Al\u00e9m disso, para que o art. 483 da CLT seja aplicado, \u00e9 necess\u00e1rio que ocorram situa\u00e7\u00f5es que n\u00e3o sejam toler\u00e1veis no \u00e2mbito trabalhista ou conviv\u00eancia. Desvio de fun\u00e7\u00e3o no trabalho<\/span><\/h3><p><span style=\"font-weight: 400;\">Quando o servi\u00e7o em espec\u00edfico n\u00e3o se encontra no contrato ou o excede, o mesmo n\u00e3o \u00e9 exig\u00edvel. Devido a isso, se o chefe quiser orden\u00e1-la, precisar\u00e1 antes incluir no plexo funcional.\u00a0<\/span><\/p><h3><span style=\"font-weight: 400;\">2. N\u00e3o cumprimento do contrato<\/span><\/h3><p><span style=\"font-weight: 400;\">Existem algumas obriga\u00e7\u00f5es contratuais assumidas pelo empregador, como dar trabalho ao seu funcion\u00e1rio, por exemplo.<\/span><\/p><p><span style=\"font-weight: 400;\">Por\u00e9m, quando al\u00e9m de promover atos que justificam a cessa\u00e7\u00e3o do v\u00ednculo, ele submete seus colaboradores a situa\u00e7\u00f5es humilhantes, \u00e9 considerado uma condi\u00e7\u00e3o de culpa patronal e consequentemente, um dano moral.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Tamb\u00e9m, se h\u00e1 o cumprimento parcial de uma obriga\u00e7\u00e3o, ela se caracteriza como descumprida, ou seja, quando o chefe paga somente uma parte do FGTS, o art. 483 da CLT possibilita a resolu\u00e7\u00e3o indireta do v\u00ednculo.<\/span><\/p><h3><span style=\"font-weight: 400;\">3.Tratativa com excesso de rigor<\/span><\/h3><p><span style=\"font-weight: 400;\">O art. 483 da CLT garante a rescis\u00e3o contratual quando seu chefe ou superiores hier\u00e1rquicos o tratam com rigor excessivo.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Ou seja, nos casos em que h\u00e1 tratamento discriminat\u00f3rio, manifesta\u00e7\u00f5es de poder exageradas, entre outras implica\u00e7\u00f5es.<\/span><\/p><h3><span style=\"font-weight: 400;\">4.Condi\u00e7\u00f5es ruins de trabalho<\/span><\/h3><p><span style=\"font-weight: 400;\">\u00c9 responsabilidade do dono da institui\u00e7\u00e3o oferecer um ambiente material e condi\u00e7\u00f5es de trabalhos sadias para seus colaboradores, tanto psicologicamente quanto fisicamente.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Por essa raz\u00e3o, ele deve monitorar e evitar formas de degrada\u00e7\u00e3o e polui\u00e7\u00e3o do espa\u00e7o. Quando isso n\u00e3o ocorre, \u00e9 direito do empregado a rescis\u00e3o segundo o art. 483 da CLT.<\/span><\/p><h3><span style=\"font-weight: 400;\">5. Redu\u00e7\u00e3o do trabalho que afete o sal\u00e1rio<\/span><\/h3><p><span style=\"font-weight: 400;\">Um exemplo de fator que afeta diretamente o trabalho e o sal\u00e1rio do empregado, \u00e9 a diminui\u00e7\u00e3o da base territorial de vendas e do n\u00famero de horas trabalhadas por quem \u00e9 remunerado por pe\u00e7a, tarefa ou cliente.<\/span><\/p><p><span style=\"font-weight: 400;\">Esta hip\u00f3tese revela uma altera\u00e7\u00e3o no contrato e isso somente pode ocorrer quando n\u00e3o h\u00e1 preju\u00edzos ao funcion\u00e1rio. A quebra disso resulta em pena de nulidade da cl\u00e1usula infringente desta garantia previamente estabelecida.\u00a0<\/span><\/p><h3><span style=\"font-weight: 400;\">6. Servi\u00e7o inexig\u00edvel ou ilegal<\/span><\/h3><p><span style=\"font-weight: 400;\">Servi\u00e7o inexig\u00edvel \u00e9 aquele que \u00e9 fora do contexto da admissibilidade, devido \u00e0 impossibilidade material, ilegal, imoral, inadequada ou fora do contrato. Nestes casos, o art. 483 da CLT pode ser acionado.<\/span><\/p><h3><span style=\"font-weight: 400;\">7. Servi\u00e7os contr\u00e1rios aos bons costumes<\/span><\/h3><p><span style=\"font-weight: 400;\">\u00c9 essencial estar ciente que os costumes s\u00e3o regras de car\u00e1ter geral, resultado da aplica\u00e7\u00e3o cont\u00ednua de determinado comportamento aceito e exig\u00edvel socialmente.<\/span><\/p><p><span style=\"font-weight: 400;\">Ou seja, os \u201cbons costumes\u201d referem-se \u00e0 utiliza\u00e7\u00e3o correta, aliados \u00e0 ordem, \u00e0 \u00e9tica e \u00e0 dec\u00eancia.<\/span><\/p><p><span style=\"font-weight: 400;\">Por isso, conforme previsto no art. 483 da CLT, se houver a imposi\u00e7\u00e3o de um trabalho que viole isso, o empregado consegue rescindir seu contrato alegando danos morais.<\/span><\/p><h3><span style=\"font-weight: 400;\">8. Mora salarial<\/span><\/h3><p><span style=\"font-weight: 400;\">A mora salarial ocorre quando, sem motivo grave e relevante, a empresa n\u00e3o paga o sal\u00e1rio dos seus colaboradores e atrasa, ou sonega tais haveres por prazo igual ou superior a tr\u00eas meses.<\/span><\/p><h3><span style=\"font-weight: 400;\">9.
